GIG SORTER TERMS & CONDITIONS

Who we are
GIG Sorter is operated by Paul Adams trading as GIG Sorter, ABN 72 206 243 757.
In these Terms, “GIG Sorter”, “we”, “us” and “our” mean Paul Adams trading as GIG Sorter.
“you” and “your” mean the person or business that creates, purchases or uses a GIG Sorter account.
Acceptance of these Terms
By creating a GIG Sorter account, starting a trial, purchasing a subscription or continuing to use GIG Sorter, you agree to these Terms and Conditions.
If you create or use an account on behalf of a business or organisation, you confirm that you have authority to accept these Terms on its behalf.
If you do not agree to these Terms, you should not use GIG Sorter.
Your subscription
Your GIG Sorter subscription gives you access to the features and services included in the plan you have selected.
Subscriptions may be offered on a monthly, annual or other billing cycle.
Unless you cancel your subscription before its next renewal date, your subscription will automatically renew for another billing period and the applicable subscription fee will be charged.
The core GIG Sorter subscription is designed to include the main software tools associated with your plan.
There is no additional software charge simply for using a core feature that is included in your subscription.
Some optional services use third party or usage based infrastructure and may attract separate charges.

That page should be read together with these Terms.
Unlimited users and contacts means GIG Sorter does not charge you per user or per contact. Usage remains subject to reasonable use, platform capacity, security requirements and any applicable third party provider limits.
Free trials
GIG Sorter may offer free trials from time to time.
The length of the trial and any conditions applying to it will be shown when you sign up or as part of the relevant offer.
Unless otherwise stated when you sign up, a paid subscription will begin automatically at the end of your free trial if you have provided a payment method and have not cancelled before the trial ends.
You may cancel during your trial to prevent the paid subscription from commencing.
Trial periods, promotional offers and eligibility requirements may vary.
We may restrict repeated trials or the creation of multiple trial accounts by the same person or business.
Founding Member pricing
Some customers may receive Founding Member or other permanently discounted subscription pricing.
Where we have specifically offered you a Founding Member rate that is locked in for life, that subscription price will remain at the agreed rate while your eligible subscription remains continuously active and paid.
Your price is locked in. You are not.
You may cancel your subscription whenever you choose.
If you cancel a Founding Member subscription and later choose to return, your previous Founding Member pricing is not guaranteed. You may be required to subscribe at the price available at the time you return.
Founding Member pricing applies to the subscription itself. It does not lock the price of separately charged third party, premium or usage based services.
Indie plan eligibility
Where GIG Sorter offers an Indie, Artist or similar discounted plan, that plan is intended for the type of customer described in the relevant offer or plan information.
We may contact you if your business, account usage or requirements appear to have moved substantially beyond the intended scope of that plan.
If another GIG Sorter plan becomes more appropriate, we may ask you to move to that plan from a future billing period.
We will not retrospectively charge you a higher subscription price merely because your circumstances have changed.
What is included
Your subscription includes access to the core GIG Sorter features identified as included with your plan.
Depending on your plan, this may include features such as:
• CRM and contact management
• Pipelines and opportunity tracking
• Email marketing tools
• Standard workflow automation
• Forms and landing pages
• Calendars and booking tools
• Tasks, notes and follow up tools
• Standard reporting and business management features
• Team member access where included with your plan
• Other core GIG Sorter features made available as part of your subscription
There is no additional GIG Sorter software fee merely because you choose to use an included core feature.
Some services associated with those features may involve external usage costs. For example, access to email marketing tools may be included while email sending above an included allowance may attract a usage charge.

Additional charges and optional services
Some GIG Sorter features rely on external platforms, telecommunications providers, artificial intelligence services, payment processors or other third party infrastructure.
These services are not necessarily included in your standard subscription price.
Additional charges may apply to services including:
• Email sending above any allowance included with your plan
• Email verification
• SMS and MMS messaging
• Phone numbers and telephone usage
• Calls, call recording and transcription services
• WhatsApp services
• Premium workflow actions
• Premium webhooks
• Artificial intelligence services
• Dedicated email sending infrastructure or dedicated IP addresses
• Premium integrations
• Marketplace applications and external software services
• Optional SEO, listings, hosting or related services
• Domain registration and renewal
• External email services
• Payment processing fees
• Other optional services that incur a direct external or usage based cost

Many of these costs are based on prices charged by the underlying technology or service provider.
GIG Sorter does not control those underlying provider prices.
Where an underlying provider changes its pricing, the amount charged for the relevant service may also change.
Separating these costs from the core subscription allows us to avoid increasing the subscription price for every customer to cover services that only some customers use.
The existence of optional paid services does not mean you need to purchase them in order to use GIG Sorter.
Many customers may never need some of the premium or usage based services available through the platform.
Where a service is optional, you are free not to use it.
Knowing when additional charges apply
Some premium or usage based services may be identified within the platform as premium features.
However, the platform may not always display the exact cost of a service immediately before every individual use.
You should therefore check the current Inclusions & Additional Charges information before activating or making significant use of a premium or usage based service:

If you are unsure whether something will incur an additional charge, please contact us before using it.
We will not deliberately add an optional paid service to your account without your authorisation.
Once you have chosen to activate or use a metered service, you are responsible for charges generated through your account by that service.
Monitoring your usage
Where practical, GIG Sorter may provide usage information, counters, reports or other tools to help you understand your account activity.
These tools are provided as a convenience and may not always update immediately.
You remain responsible for the activity generated through your account, including activity generated by automations, workflows, integrations, users or connected services that you have configured or authorised.
If you expect to undertake unusually high usage, you may contact us for information about the likely costs before proceeding.
Payment
Subscription fees are charged according to the billing cycle selected when you subscribe.
Unless otherwise stated, GIG Sorter prices are expressed in Australian dollars.
You authorise us and our payment providers to charge your nominated payment method for:
• Your subscription fees
• Authorised usage based charges
• Optional services you choose to purchase
• Other amounts properly payable under your account
Usage based charges may be billed separately from your normal subscription or included in a subsequent payment or invoice.
External providers may also charge you directly for services you use through or alongside GIG Sorter.
You are responsible for keeping your payment information current and ensuring payments can be processed when they fall due.
If a payment fails, we may attempt to process it again and may contact you to update your payment details.
Cancellation
You may cancel your GIG Sorter subscription at any time.
Cancellation stops the subscription from renewing at the end of your current paid billing period.
Unless otherwise stated, you will continue to have access until the end of the period you have already paid for.
If you are using a free trial, you should cancel before the end of the trial if you do not want the paid subscription to commence.
We do not impose a separate cancellation fee simply because you choose to leave GIG Sorter.
If you cancel a subscription carrying Founding Member or other continuing promotional pricing, you may lose that pricing and it may not be available if you return later.
Refunds and Australian Consumer Law
Subscription payments and other charges are generally not refundable simply because you change your mind, decide you no longer require the service or do not use your account during a paid billing period.
However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.
Where you are entitled to a refund, replacement, resupply or other remedy under Australian law, these Terms do not limit that entitlement.
If you believe a charge has been made incorrectly, please contact us so that we can investigate it.
Changes to plans and pricing
We may introduce new plans, retire plans or change the features included in plans from time to time.
Where we materially increase the price of your normal GIG Sorter subscription, we will provide reasonable notice before the new subscription price applies to you.
A specifically agreed Founding Member subscription rate will remain subject to the Founding Member pricing provisions above while that eligible subscription remains continuously active.
Third party and usage based costs are different from your GIG Sorter subscription price.
Prices for telecommunications, email delivery, artificial intelligence, payment processing, premium workflow services and other external services are determined wholly or partly by their underlying providers.
Those provider prices may change independently of GIG Sorter.
Where an underlying cost changes, we may adjust the corresponding usage or service charge.
Where reasonably practical, we will update the Inclusions & Additional Charges page to reflect material changes to these costs.

Nothing in this section limits any rights you may have under the Australian Consumer Law.
Templates and prebuilt systems
GIG Sorter may provide templates, workflows, automations, forms, pipelines, emails, booking processes, documents and other materials to help you set up your account.
These materials are starting points.
You are responsible for reviewing them and deciding whether they are suitable for your business.
Your business may operate differently from another GIG Sorter customer and may have different legal, regulatory, contractual or operational requirements.
The availability of a template does not mean that it is appropriate for every business or situation.
Automations
Automations can perform actions without requiring you to manually approve every individual action.
You are responsible for reviewing automations before activating them and monitoring them after they are activated.
This includes checking:
• Who will receive automated communications
• The timing of those communications
• The content being sent
• Conditions and triggers
• Tags and contact information
• Workflow actions
• Usage based services activated by the workflow
• Whether the automation continues to reflect your business requirements
Technology can fail and data can be incorrect.
You should not rely on an automation as the sole safeguard for an important legal, financial, safety or compliance obligation.
Your bookings and customers
GIG Sorter may provide tools that allow you to accept bookings, enquiries, payments, registrations or other interactions with your customers.
The commercial relationship between you and your customer remains your responsibility.
You are responsible for matters including your own:
• Prices
• Refund policies
• Cancellation terms
• Customer contracts
• Service delivery
• Taxes
• Consumer law obligations
• Insurance requirements
• Licences and permits
• Disclosures
• Customer communications
GIG Sorter is the software platform supporting those activities and is not normally a party to the agreement between you and your customer.
Account access and security
You are responsible for keeping your account access details secure.
You should use appropriate passwords and security practices and should not knowingly allow unauthorised people to access your account.
You are responsible for people you authorise to access your account.
If a team member no longer requires access, you should remove that access promptly.
Please contact us if you believe your account has been compromised.
We may take reasonable steps to protect an account where we believe unauthorised access or a security issue has occurred.
Your customer data
You retain your rights in the customer, contact and business information you place into GIG Sorter.
You give us permission to host, process, transmit and otherwise handle that information to the extent reasonably necessary to provide GIG Sorter and its associated services to you.
GIG Sorter relies on third party technology and infrastructure providers to deliver parts of the service. Information may therefore be processed or stored through those providers.
You are responsible for ensuring that you have a lawful basis for collecting, storing and using information you enter into GIG Sorter.
You are also responsible for any information collected through forms, booking systems, websites or other tools you configure using your account.
Email, SMS and electronic marketing
GIG Sorter provides tools that can be used to send email, SMS and other electronic communications.
You are responsible for ensuring that your communications comply with the laws that apply to you and your recipients.
For Australian commercial electronic messages, this includes complying with the Spam Act 2003 and associated requirements.
Among other things, you are responsible for:
• Having the required consent to send commercial messages
• Keeping appropriate evidence of consent
• Accurately identifying yourself or your business as the sender
• Providing appropriate contact information
• Including a functional unsubscribe mechanism where required
• Honouring unsubscribe requests within the period required by law
• Keeping your contact lists and consent records appropriately maintained
GIG Sorter providing the sending technology does not transfer these responsibilities to GIG Sorter.
You must not use GIG Sorter to knowingly send unlawful spam or other prohibited communications.
Acceptable use
You must use GIG Sorter lawfully and reasonably.
You must not use the service to:
• Conduct illegal activity
• Knowingly send unlawful spam
• Harass, threaten or abuse another person
• Distribute malware or malicious software
• Attempt to gain unauthorised access to systems or data
• Infringe another person's intellectual property rights
• Misrepresent your identity in a deceptive or unlawful way
• Circumvent account, billing, security or usage controls
• Intentionally interfere with the operation of GIG Sorter or its underlying infrastructure
• Use the service in a way that creates unreasonable technical or security risks
We may take reasonable action where use of an account threatens the platform, other customers, third party providers or compliance with applicable law.
Third party services
GIG Sorter is built using and connected to technology supplied by a range of third party providers.
These providers may supply services such as hosting, communications, email delivery, artificial intelligence, payment processing, integrations, domains and other infrastructure.
We do not control every aspect of those services.
Third party providers may change:
• Their prices
• Their features
• Their technical requirements
• Their service limits
• Their terms
• Their availability
• Their integrations
Where this affects GIG Sorter, we may need to make corresponding changes to the service.
We will take reasonable steps to manage changes that materially affect our customers, but we cannot guarantee that a particular third party feature or integration will remain available indefinitely.
Platform availability
We aim to keep GIG Sorter available and operating reliably.
However, no online software service can guarantee uninterrupted availability.
GIG Sorter may occasionally be unavailable because of:
• Maintenance
• Software updates
• Internet or telecommunications failures
• Third party provider outages
• Security incidents
• Technical faults
• Events outside our reasonable control
Where practical, we will work to restore affected services and minimise disruption.
We may also update, improve, replace or discontinue individual platform features as the service develops.
Your content
You retain ownership of content that you create and upload to GIG Sorter, subject to any rights that belong to another person.
You give us permission to process, store and display your content to the extent reasonably necessary to operate the services you choose to use.
You are responsible for ensuring that content you upload or distribute does not unlawfully infringe another person's rights.
This includes copyright, trade marks, privacy rights and other intellectual property or legal rights.
Artificial intelligence features
Some optional GIG Sorter features may use artificial intelligence.
Artificial intelligence output can contain errors, omissions or inaccurate information.
You are responsible for reviewing AI generated content before using, publishing or relying on it.
You should apply appropriate human judgement to important decisions and should not assume an AI generated response is legally, financially, technically or factually correct merely because it was produced through GIG Sorter.
Artificial intelligence services may also attract separate usage charges as explained on the Inclusions & Additional Charges page.
Exporting your data
Where the platform provides export functionality, you may export your data using the tools available to your account.
If you intend to cancel GIG Sorter, you should export information you wish to retain before your account access ends.
Following cancellation or termination, your account data may eventually be removed from active systems in accordance with our operational, legal and provider retention requirements.
We cannot guarantee that information can be recovered after it has been deleted.
You are responsible for maintaining any independent records that your business is legally required to keep.
Intellectual property
GIG Sorter and its licensors retain ownership of the software, platform, branding, systems, templates and other intellectual property supplied as part of the service, except for material that belongs to you or another third party.
Your subscription gives you a right to use GIG Sorter while your account is active. It does not transfer ownership of the software or platform to you.
You must not copy, resell, reverse engineer or commercially exploit GIG Sorter's proprietary materials except where expressly permitted or where the law gives you a right that cannot be excluded.
No professional advice
GIG Sorter is a business software service.
Information, templates, workflows, examples, AI outputs and other materials provided through GIG Sorter are not a substitute for professional legal, accounting, tax, financial or other specialist advice.
You remain responsible for deciding what requirements apply to your business and obtaining appropriate professional advice where necessary.
Responsibility and liability
We will provide GIG Sorter with reasonable care and skill.
However, your results depend on many matters outside our control, including how you configure and use the platform, the information entered into it, your business decisions and the operation of third party services.
To the extent permitted by law, GIG Sorter is not responsible for loss caused by:
• Incorrect information entered by you or your authorised users
• Automations or workflows configured or approved by you
• Your failure to monitor your account or communications
• Unlawful or inappropriate use of the platform
• Third party systems or services outside our reasonable control
• Failure by you to maintain required records or backups
• Your failure to comply with laws applying to your business
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
In particular, nothing in these Terms excludes rights or remedies that cannot be excluded under the Australian Consumer Law.
Suspension and termination
We may suspend access to all or part of an account where reasonably necessary because of:
• A serious or continuing breach of these Terms
• Non payment
• Suspected fraud
• Unlawful activity
• A significant security risk
• Serious misuse of the platform
• Conduct that threatens the operation of the service or other customers
• A requirement imposed by law or a service provider
Where reasonably practical, we will contact you and give you an opportunity to resolve the issue before terminating an account.
Immediate action may be necessary where there is a serious security, legal or operational risk.
You remain free to cancel your own subscription in accordance with the cancellation provisions above.
Changes to these Terms
We may update these Terms as GIG Sorter develops, our services change or legal and regulatory requirements change.
Where a change is material, we will take reasonable steps to notify affected customers before or when the change takes effect.
The current version of these Terms will be published on the GIG Sorter website with its last updated date.
Minor changes, corrections and clarifications may be made without individual notice.
Nothing in this section allows us to remove rights that cannot legally be excluded.
Complaints and problems
If something goes wrong, please contact us.
We would prefer the opportunity to understand the problem and try to resolve it.
If you believe you have been incorrectly charged, that the service has not operated as expected or that we have failed to meet an obligation, please provide enough information for us to investigate the issue.
Nothing in this process prevents you from exercising any legal right or contacting an appropriate regulator or dispute resolution body.
Privacy
We take the handling of personal information seriously.
Our Privacy Policy explains how we collect, use, store and disclose personal information in connection with GIG Sorter.
You should read the Privacy Policy together with these Terms.
You are separately responsible for the personal information you collect from your own customers and contacts through your GIG Sorter account and for complying with privacy laws that apply to your business.
Notices and communications
We may send notices relating to your GIG Sorter account electronically, including by email or through the platform.
You are responsible for keeping the contact information associated with your account current.
Operational, billing, security and legal communications relating to your account are different from optional marketing communications and may still need to be sent to you while you hold an account.
Governing law
These Terms are governed by the laws of Queensland, Australia.
You and GIG Sorter submit to the courts and tribunals having jurisdiction in Queensland, subject to any legal rights that allow a matter to be brought elsewhere.
Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the minimum extent necessary.
The remainder of these Terms will continue to operate.
Entire agreement
These Terms, together with your applicable plan information, the Inclusions & Additional Charges information, Privacy Policy and any specific written offer or agreement applying to your subscription, form the agreement relating to your use of GIG Sorter.
Where a specific written offer expressly gives you a benefit such as Founding Member pricing, that specific benefit continues according to the terms of that offer.

GIG Sorter is designed to be a simple, affordable platform that gives you the tools to manage your business without the cost of a large enterprise software package.
Your subscription includes access to our help resources and reasonable support for questions about using GIG Sorter.
Support is primarily provided by email and through our help and training resources.
We can help you understand how existing GIG Sorter features work and point you toward the right tools or processes.
Your subscription does not include ongoing business consulting, custom workflow design, data entry, website building, campaign creation or bespoke system development.
If you would like us to build, configure or customise parts of your system for you, additional implementation or consulting services may be available for a separate fee.
GIG Sorter is not intended to provide an instant response help desk or 24 hour technical support service. We will respond to support requests as reasonably practicable.
